The Bitch and Bad Vibes! UK News Review

June 30th, 2008 by monasterio2355

Well Darlings,

Do you ever get the feeling that something is about to happen? I know I do. It’s a feeling of apprehension, and it comes with a sort of impotence - a sense of knowing that whatever it is that is about to happen, I will be unlikely to be able to do anything at all about it. I’m getting that kind of a feeling now, and it’s coming across strongly. I feel like we are all living in the lull before the storm; a mighty storm. However from whence it will come, or even of its constituent elements, I have not the slightest inkling - and that is most annoying.

I have several fears, all that I pray are unfounded. Our armed forces, arguably amongst the best in the world, are performing their duties admirably around the world - although perhaps not so much these days for Queen and country as for the whims of a double act known as George & Tony - and they are doing it against all the odds. There is hardly a week goes by when we don’t hear something about some shortfall somewhere encountered by our troops. These shortfalls range from a lack of the correct type of equipment - reliable equipment - right through to a disturbing lack of manpower. Many of our gallant boys and girls are suffering prolonged front-line tours of duty.

We must by now all have seen the commanders in the field on our televisions, brave men and women telling us how much they were over-stretched - performing to new limits of human endurance - but were still holding their own. Lately, in both Afghanistan and Iraq, the words bitten off more than we can chew have started to creep into many a politician’s repertoire. Today we hear Major Jon Swift, who is serving in Afghanistan, claiming that Britain is sustaining higher casualties than the official figures reveal, and telling us our soldiers are often just patched up and sent back to fight without the injury being recorded. He says: The scale of casualties has not been properly reported and shows no sign of reducing. Political and not military imperatives are being followed in the campaign. Another British Army major there has condemned the RAF as being utterly, utterly useless , suggesting that more helicopters and manpower are desperately needed.

Needed they may be, but do we have them? If you remember, recently there were not enough spare troops available to even man a few dozen Green Goddesses during the industrial action taken by firemen in one of our cities. It is a situation I find worrying, and to me it poses the question: what if? What if something else were to kick off big style in the world? What if it should be more pertinent to us here in Britain than is Afghanistan or Iraq? What then?

As long as I can remember, and I’m quite long in the tooth, we have had defence cut after defence cut. I may be wrong, but I can’t remember any time in recent history when we have allocated more money, substantially more money in real terms, for the defence of our country. From ships to aircraft to manpower, for years we have cut back, cut back, cut back, and just when you believed there was nothing left to be cut anymore some Chancellor of the Exchequer would again slash the armed forces’ budgets.

A smaller defence budget may be okay for some - for those who believe it is a move towards more peaceable times - but it is totally inappropriate for a country that still tries to be a policeman for the world. We need either to spend more money on our military capabilities, substantially more, or else to accept our limitations and butt out of other nations’ affairs. To ask our troops, those people who know their career might one day call for the ultimate sacrifice, to perform their duties against such bad odds is wrong, and it does nothing to bring peace in the world any closer. All it brings closer is the day when we may have no alternative than to accept a humongous and mortifying British defeat or, God forbid, have to use our ultimate weapons of destruction.

Just to make you all feel safer, did you catch the latest possible (spelt: probable) cuts? Defence chiefs are now looking at Britain’s naval bases: Faslane, on Scotland’s River Clyde, Portsmouth, and Devonport in a review that, we are warned, may lead to job cuts or even closures. The Ministry of Defence tell us the results of their review will not be known until at least the middle of next year, and that it is far too early to know what any reduction to our surface fleet might have on jobs.

Faslane is the HQ of the Royal Navy in Scotland, and is the home of the UK’s Vanguard class of nuclear ballistic submarines armed with Trident missiles. Portsmouth is home to a major part of the Royal Navy’s surface fleet, much of it simply moored there because there is little money to keep it at sea, and Devonport, with its 15 dry docks and 4 miles of shoreline, is Britain’s largest naval base and the home of 7 of our Trafalgar class nuclear-powered hunter-killer submarines.

With all the unrest there is in the world today, is this really the right time to be looking for more cuts? George & Tony may not be around forever, but the way things are looking at the moment there is every likelihood that long after they’ve gone our forces could still be fighting and dying for these two politicians’ dreams. One day historians will make much of that!

Terrorism is another fear I have these days, and one I guess that now most people must have hidden away somewhere at the back of their minds. Like most people too, I suppose, I don’t actually fear so much for my own safety, but I dread the massive carnage that may come some day - will come, we are told by our police forces - and how much that would undoubtedly affect so many innocent people. We hear of some remarkable successes by the police and intelligence services in deterring the terrorists’ actions (as well as hearing of their mistakes), but it’s the one we won’t hear about one day which will be the one that really matters.

When we learn that a businessman, Mark Coshever, after accidentally picking up the wrong passport at home, was able to fly from Luton to Amsterdam on his child’s passport without it being noticed, one begins to realise just how vulnerable we may be. Apparently airline staff examined Mark’s passport twice, yet they still failed to notice the photo it contained was of his daughter - a toddler! Security? I guess it only happens for beards and suntans!

There are so many things wrong with the world today from which my apprehension may have sprung. Global warming, once thought to be a figment of some crank’s imagination, then accepted as possibly going to be harmful to us in a hundred years or so, then found likely to be detrimental to the planet in half that time, and now admitted to be something for which no one can do much more than guess at its consequences, but they may be more imminent than ever before supposed, and far more devastating than previously believed with countries fighting each other for something more precious than gold or oil - drinking water - is another topic that worries me. I may not be around to see it, but I do have kith and kin.

The problems we have in society today (the society with a small ’s’) worries me too. I come from a time when schoolchildren didn’t know where they could buy a gun, and none of them carried knives. A fight was just that - a black eye, and not a killing. Crime happened, of course it did, but nobody feared it. Even our underworld adhered to a moral code. An elderly person could walk down any street in their town, day or night, without a care - today none but a fool would attempt it. It was a time before we had do-gooders , a time when we looked after each other, and a time before the millions of rules and regulations that are imposed on us today - some of them the very cause of many of our troubles.

Since the late sixties the values and the quality of society has deteriorated. It was a slow deterioration at first, and certainly never one as noticeable as it has been in the last ten years. We have seen some remarkable changes recently, and I fear for where we are heading. Taking the dreaded exponential factor of the decay into consideration, unless a turn-round happens soon, ten years from now doesn’t bear thinking about.

Today there are many battles on our planet being lost. I’m wondering which of them it is that might be bothering me at this moment. Perhaps it is none of them I’ve mentioned here. Maybe it is something entirely different. The rogue asteroid? The expected apocalyptic tsunami from when that bit of the Canaries falls into the ocean? The deadly virus that mutates and goes airborne? I don’t know what it is, but something is definitely nagging at me. I feel like a balloon is being blown up in front of me - it will explode soon, but I don’t know exactly when, and I am waiting for the moment.

Hopefully I shall see you all next week . . .

A Fishing Guide Made Easy

June 30th, 2008 by monasterio2355

Fishing is considered a favorite past time among Americans. A majority of Americans have had the ultimate fishing experience. Fishing is the activity of catching species that live and breathe underwater.

Today more advanced fishing techniques were developed to make the activity more exciting and challenging. Before 2005, all fishermen had to do was hit a macro to catch a fish. Today there is a more developed fishing system; it involves fighting a fish to reel it in.

A simple fishing guide would make understanding fishing easier. There are five steps to follow for beginners. Start out by preparing your rod and reel. The reel has to have a line then press the button of your spin-cast reel. Make sure that enough line is pulled to thread it through all of the guides of the rod.

In the second step of the fishing guide it is important to attach a hook. One thing about hooks is that they come in different shapes and sizes. An acceptable size to use is #6 or #8. A clinch should be used to tie the hook to the line.

The third step of the fishing guide involves attaching a bobber by threading the line to the top and bottom hooks. The purpose is to attach the bobber so the fish hook hangs just above the structure.

Attaching the bait is the next step. Attach the bait to the hook using either worm rig method, worm rig for bait stealers method or doughball method.

The final step in the fishing process is to cast and retrieve. First cast the bait, then turn the reel crank forward until it clicks to prevent more line from coming out. You know you are catching a fish when the bobber moves or when you feel a tug on the line. Make sure the hook is in the fish’s mouth. If more detailed instructions are needed there are numerous fishing guides on the web or in books.

One guideline is very important before going fishing. Check the fishing regulations to see if the fish you catch according to size is legal to keep. If it is a fish that is not legal to keep, it must be released and handled as little as possible.

If this is a fish that can be kept a good way to keep it alive is to place it in a cooler until it is ready to be cleaned. So if your purpose is fish as hobby and use the catch and release method, fishing regulations do not need to be considered. Fishing is mostly done for recreational purposes, such as fishing tournaments or hobby but some actually catch fish that they plan to cook with. Whatever the reason your reason for fishing is it blends well with the American way of life. Remember to take along your fishing guide!

Child Tax Credit - Are You Eligible and How Much Can You Claim

June 30th, 2008 by monasterio2355

Child Tax Credit - Are You Eligible And How Much Can You Claim?

In our hectic world today, raising kids can be difficult, particularly when funds are tight. Children are always going to need something, whether it be new clothes or supplies for a school project. Figuring out how to find the money can sometimes be just about impossible. However, there are government benefits that are available to struggling and low income households that may help to lessen the burden in situations like these.

One of these benefits is the Child Tax Credit, which was created and intended to lend a helping hand to families and caregivers of school age children and college students to ensure that the children can get the things they need. This will be especially helpful to low income parents who have children younger than 16 or a young person attending school full time.

This particular Tax Credit is based upon the number of children in your home and also takes into account the total household earnings. As well as getting an overall tax credit for the family, you also can claim a specific amount ofchild benefit for every child who lives in your home. You don’t need to be related to the child or children, but you must be the primary caregiver and the children have to reside in your house.

Claiming the Child Tax Credit is extremely simple. When you apply initially, you will have to order a claim pack. You will also need to give proof of your identity, which can be as easy as providing your national insurance number. Once you’re approved, your Child Tax Credit can be renewed by mail or telephone. This is done each year and you’ll be notified when it’s time for you to renew. It’s important for you to report any changes in your situation such as even the slightest changes in family size and earnings. If you fail to report changes, you might wind up having to pay back the tax credits that you’ve received.

You can receive Child Tax Credits in numerous ways. You can have the child allowance paid on a weekly or monthly basis, and it can be transferred into any bank account you indicate. Children’s Tax Credits needs to be transferred to the main caretaker’s account and can be received by cheque, which will be sent to the address indicated on your application. The child benefit can be claimed additionally with the Working Tax Credit, a government benefit if either you or your partner are working.

If you don’t get approved these benefit entitlements, or disagree with your tax credit calculation, you have to right to appeal a tax credit decision. This must be done within 30 days of your denial notification.

Some Wonderful Christmas Decorating Ideas

June 30th, 2008 by monasterio2355

Christmas can bring back a lot of wonderful memories. The holiday season is a very sentimental time that is often associated with the fine details in holiday d?cor. Many people capture wonderful memories of their childhood by incorporating rustic elements in their Christmas decorating ideas.

It can be challenging to find the right details to create a cozy feeling in your home during the holiday season. You need a bit of creativity and imagination when you come up with Christmas decorating ideas. Ordinary objects can be used to create an atmosphere reminiscent of a log cabin or a country farmhouse.

This theme can be accomplished by using simple elements that bring the woods indoors. You can use pine cones and berries to adorn areas of the home. Fine details like birdhouses and wild animal ornaments can really bring the woods into your home.

My personal favorite is country inspired Christmas d?cor. There are many elements that can bring a traditional feel to your home. These Christmas decoration ideas can also incorporate Victorian items as well, giving the country decorations a classic mood. Small baskets, lace doilies, and glowing candles can help create a wonderful country Christmas.

You can also find ideas from quilters since they are very creative persons. Quilters can create items that are appropriate for the holiday season that can be displayed with pride. Christmas decorating ideas that use quilting supplies include ornaments made out of quilt blocks or Styrofoam balls covered with recycled materials.

You can discover your own ways of bringing rustic charm into your living space during Christmas. Food is one of the Christmas decorating ideas that are often overlooked. You can find old fashioned recipes to make snacks and beverages that can be part of your holiday d?cor as well. Gingerbread men and Eggnog served in decorative glasses are just two Christmas decorating ideas that incorporate food into your overall d?cor. Making use of simple details can help you create a traditional Christmas atmosphere in your home.

Walleye Fishing Tips

June 30th, 2008 by monasterio2355

Here is a simple walleye fishing tip that I use for one area of a lake I fish frequenly on Manitoulin Island and the lake is Mindemoya lake. This walleye fishing tip will work on most lakes of various sizes anywhere walleye are caught.

I have been catching walleye for over 50 years all across Canada. During that time I have learned a lot of things about fishing. But always remember that you can usually learn some new tricks and tips at any time.

Over the many years that I have fished this area I see so many anglers full of enthusiasm and expectations come and leave just frustrated with their experience fishing walleye. This fishing tip will help eliminate that frustration. It may not make you an expert, but it will make a difference in your fishing results.

Lake Mindemoya is not a large lake but to know where certain features of the lake are is great information to have. Depth, where to find shoals, sunken islands or structure that walleye love and frequent. My favorite spot on this lake is what is called Grassy Island and in the north west corner of the lake. It is actually what I call a sunken island because the only time it is actually visible from anywhere is in the summer when the reeds and grass are growing. In fact the hottest time of the summer is a great time for fishing walleye.

Now the first thing is of course is your rod and reel, sounds simple but be sure to use good fishing equipment. A light action graphite rod and reel with 6 or 8 pound test line is sufficient to catch and land most large walleyes.

The last thing is of course the simplest the hook. A plain unadorned ball-headed jig is king here. It is simple and easy to use, and deadly. Use 1/4 ounce as much as possible. If you have a problem finding the bottom you can move up to 3/8 ounce till you get used to finding the bottom.

These jigs have no action of their own, so that is up to the angler, short hops seem to work best but do not be afraid to experiment. Try to maintain contact with the bottom at all times, but try not to bounce on slack line. This can cause you to get snagged more often.

Jigs are great for catch and release, most of the time the walleye will be hooked in the top lip. Unhooking is fast and easy for you and the fish.

Tip jigs with either a minnow or a leech. I like to use leeches but at times minnows will work best. I usually carry both so I can test which is working best that day or for the area you are fishing.

Well now put this all together and lets catch those walleyes. Off the edge of this grassy island or sunken island as I call it there is a drop off and the walleye hold to this at different depths at different times of the day. Deeper during the heat of the day and closer in the evening.

The area I fish I am usually able to drift slowly over this reef from one end to the other and preset my jig and bait offering easily plus with great success. If you use electronics of any kind of course you can find these walleyes and where they are holding up. Also if it is too windy to drift the way you want a trolling motor can keep you in the thick of the action or even anchor.

Walleye do not like bright light and most anglers think that the best time for fishing walleye is early morning or in the evening and even after dark. But on Mindemoya Lake in the heat of summer you have an algae growth that clouds the water somewhat and makes for great fishing even in the heat of the day. As simple as this walleye fishing tip seems, remember it works and just experiment and you will succeed.

So to wrap this up if you ever get to my favorite place on earth, Manitoulin Island and happen to be near grassy island on Mindemoya Lake say hello to the oldtimer you see out there all alone in his Lund boat. Do not be afraid to ask questions, because he will have fish! Get out there and enjoy nature and relax!

How To Handle A Child With Anorexia

June 30th, 2008 by monasterio2355

According to the National Institutes of Health, about 0.5 to 3.7 percent of girls and women will develop anorexia nervosa over a lifetime, and around 1.1 to 4.2 percent will develop bulimia nervosa. Nearly 0.5 percent of anorexics die each year from the illness, making it one of the top psychiatric illnesses to cause death.

Those suffering from anorexia are extremely fearful of gaining extra weight and may exhibit negative behaviors and actions leading to severe weight loss. Pounds are lost by over-exercising and restricting calorie intake. Anorexics view their bodies in a distorted way. When they look in the mirror, despite being dangerously thin, they see themselves as too heavy. For concerned parents who have children with anorexia, there is an array of assistance available from programs at hospitals, treatment centers, and clinics specializing in eating disorder recovery.

One of the problems in overcoming anorexia is that those with the illness don’t usually see it that way-that don’t think they are sick. If somebody with anorexia is in immediate danger, they might need emergency care for malnourishment, including dehydration and electrolyte imbalances.

Long-term treatment entails a team effort with professionals trained in eating disorders, including dieticians, mental health professionals, medical doctors, and treatment centers:

? Dieticians. A dietitian will create meal plans and monitor calorie intake to implement a healthy diet. However, there’s more to recovering from an eating disorder than changing one’s eating habits.

? Mental Health Professionals. People who suffer from anorexia suffer emotionally and mentally as well. They need change the way they view themselves to boost their self-esteem, and their mood can benefit from carefully prescribed and monitored antidepressants. Psychiatric treatment sessions typically last at least a year and take place one-on-one, with family, or with other people with eating disorders.

? Medical Providers. While those still in the early stages (less than 6 months) typically avoid hospital stays, for people with advanced cases, checking into a unit for anorexia or bulimia may be required. People with anorexia need constant monitoring of electrolytes, hydration levels, and vital signs. A doctor should be involved in the on-going medical treatment.

? Treatment Centers. Clinics across the country provide a live-in environment for children suffering from anorexia. These centers provide a treatment team-dieticians, psychiatrists, and doctors-under one roof. Such programs entail an extended stay.

While concerned parents can’t force children with anorexia to stop, it is imperative to support them in their struggles. More and more, doctors and patients advocate family-centered therapy-letting parents back into the treatment process. For decades, parents were seen as an anorexic’s biggest problem and were even blamed as the cause for the disorder. Research has shown that while parents can influence a child’s eating disorder, they are typically not the cause. Known as the Maudsley approach (after the London-based hospital it was developed in), family-centered therapy focuses on helping parents become a support system. Food is the “medicine” to treat the illness, and doctors coach parents and their child through meals and appropriate behavior in a clinical setting. After a few tries, families are then sent home to continue the treatment. Patients benefit from the love and support afamily network provides.

Regardless of the approach settled on, for any treatment program to be successful, those with anorexia need the continued support of family and friends. Following is advice for parents, courtesy of The National Eating Disorders Foundation (www.edap.org):

Educate yourself about eating disorders. Read as much material as you can in magazines, books, articles, and brochures.

Understand the differences between facts and myths about weight, nutrition, and exercise. Being armed with facts will help you reason with your child about the misconceptions they adhere to.

Be truthful. Don’t be afraid to voice your concerns to a child who struggles with eating or body image issues. Pretending the problem doesn’t exist does not help.

Be loving, yet firm. Loving your means you hold them accountable for their actions and the consequences of those actions. It does not mean you let them manipulate you. Do not make rules or promise you can’t or don’t intend to uphold, such as “I won’t tell anyone” or “If you do this anymore I won’t ever speak with you.”

Sincerely compliment your child on their terrific personality, accomplishments, or contributions. Reinforce the idea that beauty is not just skin deep.

Be a positive example in regard to your own eating, exercising, and self-acceptance.

Know when to share. It can be hard to know if you should share your concerns with somebody else, if at all. By addressing issues with eating or body image early, you stand a better chance of working through the issues with your child. Don’t wait to seek help until your child is extremely sick. They need as much support from you as possible.

CSI Continues - The Difficult Seventh Season

June 30th, 2008 by monasterio2355

Well, it’s that time of year again. For the seventh year running, this fall season we’ll see a new season of CSI: Crime Scene Investigation hit our screens.

Since its debut in the fall season of 2000, CSI: Crime Scene Investigation has been a major draw for the CBS Network. It became the most watched program on television in the 2002-2003 season, and has since remained in the top 3 most popular shows ever since. As of the sixth season each episode attracted an average of 30 million viewers, and 90 million people have seen the show in the past year.

The sixth season closed with a spectacular two-parter in which Detective Jim Brass was left fighting for life after a hostage negotiation went wrong. When murderer Willie Cutler took a woman hostage in a Vegas hotel room, Brass volunteered to negotiate. However, when things went awry Cutler fired three shots at Brass - and one of the shots breached his bulletproof vest, a bullet lodging in his heart.

After Brass was rushed to hospital in critical condition, CSI Gil Grissom was informed that Brass had nominated him as his medical proxy, which meant that Grissom had to decide whether to allow doctors to perform risky surgery to remove the bullet or - equally dangerous - leave the bullet where it was and risk a stroke. Grissom, believing that Brass would have wanted it, ordered the surgery.

Meanwhile, Brass’ estranged daughter Ellie arrived, more interested in how much she’d get from her father’s pension scheme than in his well being. Grissom tried to make Ellie understand how much Brass cares for her, but Ellie seemed unwilling to listen. By the time Brass regained consciousness she had left, but Brass’ CSI family were still by his side.

The season closed on a surprising note with Grissom finally getting together with Sara Sidle - a story arc that has been several years in the making.

So what does the next season have in store for CSI fans? Well, while the show will no doubt continue with the format that has seen it become one of the most successful shows on TV the main story in the coming season must revolve around the CSIs relationships. With a new romance blooming between Grissom and Sidle it will be interesting to see how these two loners will adapt to the new situation.

On that count, at least, even the stars of the show don’t know how it will turn out. Jorja Fox, the actor who plays Sidle, didn’t know that she and Grissom were getting together until just a few days before filming, but she believes that this one is for keeps: These two people, they have a lot in common. They’re both really not great with people in many respects, and they’re emotionally detached in many respects. If two people like that can kind of find each other, there’s something really beautiful in that.

But it won’t just be the relationship between Grissom and Sidle hogging the limelight. As we saw in the penultimate episode of season six Warwick Brown’s marriage is on the rocks. After spotting his wife Tina with another man in the Lucky Dragon Casino Warwick confronted her, not realizing that she was planning a surprise party for Warwick’s birthday. If Tina walks out on him, will Catherine offer Warwick a shoulder to cry on?

We’ll have to wait and see… the story will unfold during the seventh season of CSI: Crime Scene Investigation on CBS this fall.

Understanding The Law… Defacto, Divorce And Family Law

June 30th, 2008 by monasterio2355

The following Q&A’s have been provided to help you better understand Family Law.

Q. I recently divorced my husband who has left me with the four children and he has suggested that as we have no assets he will give me half of his superannuation. What should I do as I am unemployed and on a single mother’s supporting pension and he does not pay child support?

A. Unfortunately you are being very badly treated as your entitlements would include spousal maintenance, child support (see the child support agency) and access to at least 50% of his superannuation. You need to seek urgent legal assistance and perhaps legal aid is where you should look first.

Q. I have been divorced from my former husband for over seven years and although I am in employment he has been on the dole throughout and has a history of violence. Recently he approached me and suggested that as he was now in a stable relationship he would like to have contact with our son. What should I do?

A. In all cases involving children it always gets back to what is in the best interests of the child. Should your ex-husband have a history of violence involving both yourself and the child, custody would not be an issue and supervised contact is probably what would be allowed. This always gets back to working out a program which will be acceptable to both parties provided that the child will not suffer as a result.

Q. I am currently involved in a de-facto relationship and my partner has excluded me from the home by locking me out. What can I do as she has become personally violent towards me and we need to sell the house so we can go our separate ways?

A. In regard to the property you should ask your solicitor to write to your ex-partner indicating that you wish to have the property sold and if they do not comply then you can always approach the Equity Division of the Supreme Court for relief.

Q. Do you think it advisable for me to enter into a financial agreement with my intended defacto partner as I have all the assets and she has very little?

A. Yes. There are a number of reasons for doing this but principally you need to ensure you are fully protected given your age and if the relationship breaks down then you have a level of protection which would not otherwise be available to you.

Q. I have been involved in a same-sex relationship with another person for over 20 years and I have retained a firm of solicitors who seem reluctant to push my case as strongly as I would like. The other side is making mincemeat out of my representative who does not seem to know what to do to counter their attacks. What do I do in the circumstances?

A. If you are unhappy with the type of representation you are receiving and the service is falling well short of your expectations then you need to consider whether or not it is in your best interests to move to another lawyer. Same-sex defacto relationships and marriages which fail all require representatives who possess skills appropriate to best represent their client’s interests. If counselling, mediation and conciliation has not worked for you such that you find you are under constant attack and need to take a more forceful approach then perhaps it is time for you to consider changing lawyers to one who can better represent your interests as a 5-10% swing in entitlements from one party to another may mean that legal fees become irrelevant in this context as you will need to fully protect your interests in these circumstances.

Q. I have just broken up with my defacto partner and everything was in her name, although I did a lot of building work to improve the property and paid the mortgage instalments whilst we were together. Am I entitled to be recompensed for my contribution to the relationship?

A. Yes. Effectively where two people are in a defacto relationship and one makes all the financial contributions to it whilst the other takes the benefits even though they may own the principal asset the court will look to the nature and extent of the financial contributions you have made and the assets will split based on this after accounts have been taken.

Q. My boyfriend has a couple of children to an ex-girlfriend who has packed up, moved on and not told anyone where she has gone. Is there anything my boyfriend can do?

A. Yes. He can approach the court for orders which means that anybody who has any knowledge of those children’s whereabouts has to deliver up information so that their current location can be discovered so the court can make orders for their return.

Q. I am a grandmother - do I have any rights to see my grandchildren?

A. Yes. You fit within a particular class of important individuals which the court considers important to the development of your children and therefore you would be entitled to see them after you have approached the court for orders.

Q. What effect with the new changes in the family law system have on children?

A. All children will have a right to know both their parents and to be protected from harm.

Q. What impact will the new changes have on parents?

A. Parenting is regarded as a responsibility which should be shared equally. This may not mean equal time; it could mean substantial or significant time spent by both parents with the child.

Q. Is it true that these new family law changes mainly focus on children?

A. Yes. These changes in the law are all about putting the needs and best interests of children first.

Q. What are the responsibilities of parents in this regard?

A. Parents bear the responsibility for their children’s physical and emotional wellbeing which should be share equally between parents provided they are not subjected to abuse or violence. Co-operation between separating or separated parents is an essential part of these reforms.

Q. Do these reforms mean that children will spent equal amounts of time with each parent?

A. No. The focus is both parents will have an equal role in making decisions about important issues such as schooling and health care.

Q. How do parenting plans and parenting orders sit with each other?

A. Basically it means that both the parents and the court need to have the best interests of the child in mind at all times when making decisions affecting the child’s wellbeing.

Q. How will the courts determine how much time the child spends with each parent?

A. Courts will determine this by reference to what is in the best interests of the child and other practical considerations. Time can mean equal time or substantial or significant time with both parents which may include day to day routine time not just weekends and holidays.

Q. When will these changes which focus on cooperatively resolving disputes come into operation?

A. It is expected they will start on 1st July 2007 when parents will be required to attend family disputes resolution sessions and be expected to make a genuine effort to resolve issues and disputes before taking a parenting matter to court.

Q. How does the court system accommodate these changes?

A. In parenting cases there will be change to a case-management approach with the focus being on the early detection and dealing with of violence and abuse.

Q. What will happen where there has been a breach of parenting orders?

A. The court will have wider powers to deal with people who breach parenting orders.

Q. What will happen where parents fail to fulfil their responsibilities?

A. Where parents fail to fulfil their major parenting responsibilities the courts will be able to take these matters into account.

Q. At what stage will this disputes resolution mechanism come into play?

A. Separating parents will be required to undertake some form of disputes resolution for parenting disagreements before proceeding to court. Parents will have access to the new family relationship centres or may attend another accredited service or practitioner in this regard.

Q. Will it be compulsory for separating couples to attend a family relationship centre?

A. No, but the law will require separating parents to attempt disputes resolution before taking a parenting dispute to court.

Q. What does the court bear in mind when considering what is in the best interests of the child?

A. That the children know both their parents and to be protected from harm each being given equal weight.

Q. Are there any other considerations which are taken into account?

A. Yes. Additional consideration is given to views expressed by the child, the nature of the child’s relationship with his/her parents and other important persons such as grandparents, relatives and extended family members as well as the practical difficulties of a child having contact with a parent(s).

Q. Are children entitled to independent legal advice where a matter proceeds to court?

A. Yes. The court may order an independent lawyer be engaged to represent the best interests of the child and to inform the court of their independent view in this connection.

Q. What is a parenting plan?

A. A parenting plan is an agreement worked out between a child’s separating parents which can take any form provided it sets out the parenting arrangements for children. It must be produced in writing and dated and signed by both parents.

Q. Can a parenting plan be changed at any time?

A. Yes, as it is voluntary it needs to have the agreement of both parents. It should be borne in mind that parenting plans are not legally enforceable.

Q. Will the court have any regard to parenting plans if they are not legally enforceable?

A. When the court is making a parenting order in relation to a child they are required to consider the terms of the most recent parenting plan and to consider the extent to which both parents have complied with their obligations in relation to the child.

Q. Where a court has made a parenting order with respect to parenting arrangements can the parents change it without having to go back to court?

A. Yes provided the court order does not prohibit this.

Q. Although it is expected that family disputes resolution to new parenting cases will apply from mid-2007 when will it apply to all parenting cases?

A. The final date is expected to be mid-2008 but it will not apply in cases of family violence or child abuse.

Q. Will family disputes resolution apply in all cases?

A. No. It will only apply to parents who want to go to court over a parenting issue where it is compulsory unless they fit within the listed exceptions or where they have already agreed on parenting arrangements.

Q. How does the court know that compulsory family disputes resolution has already taken place?

A. This is because a certificate is required from an accredited family disputes resolution practitioner before the court can hear an application for a parenting order. Basically the certificate states that family disputes resolution did not work for a number of reasons.

Q. How will family violence and child abuse be dealt with under the current changes?

A. Family violence and child abuse will not be tolerated. This is the fundamental principle of the new reforms. Family violence includes actions or threats by a person against any family member or their property including witnessing such actions or threats. Fear and the apprehension of violence are addressed. A person must reasonably fear for or be apprehensive about their personal wellbeing or safety. The courts are required to act promptly in cases of violence or abuse. State and territory agencies are expected to investigate allegations of violence and abuse without delay.

Q. My de-facto partner and I recently separated and it is proposed that we split the assets 50:50. What should I do?

A. If there are no children then it is purely and simply a question of splitting the assets but it should be remembered that de-facto couples are not treated as generously as married couples. It really gets down to taking accounts and the extent of financial contribution made by each partner.

Acoustic or Electric Guitar - Which Is Best For The Beginner

June 30th, 2008 by monasterio2355

Having played the guitar for a number of years, I am often asked this question by eager learners - Should I start learning with the acoustic or electric guitar? In this article, I’ll talk a bit about both so you can come to an informed decision.

First of all, let me get something straight. The actual notes and fretboards work the same for both, so if you start with either one, its always interchangeable, although the playing techniques might differ.

Most younger players would gravitate towards the electric guitar thanks to MTV and the cool factor . The acoustic guitar seems to have a more folksy image to it. Both sound very different, with the acoustic relying purely on natural acoustic principles to generate the sound, using the body of the guitar as an amplifier . The electric guitar on the other hand needs an electric amplifier to generate sound. There are of course hybrids, but that is not relevent in this article.

So, which is better for the beginner? I’ll cover 3 aspects below - cost, convenience and playability.

Cost

Both are about the same, you can get really expensive custom built electric of acoustic guitars. However, the electric can start to get more expensive simply because of the tempting options and accessories like amplifiers, pre-amps, effects pedals, volume pedals, etc. The acoustic on the other hand might be simpler to start with. It plays right out of the box!

Convenience

Again the acoustic wins as you can take it almost everywhere without worrying about a power socket. There are personal practice gadgets available for the electric guitar which allows you to practice with headphones.

Playability

My personal preference here is the electric guitar. I find it easier to play, with the strings being softer and thus less effort to play.

Either way, they both should be respected and used for what they are and any good guitarist should be adept at both. For the beginner, I would prefer the acoustic as it helps a lot in ear training as you get accustomed to the vibrations of the body making the tuning of the strings are easier to detect.

My final piece of advice is to don’t get too obsessed with your instrument while you’re learning but focus on the music instead. Once you start to get better at it you’ll know instinctively what sort of ‘ax’ you’ll need. I’ve met my fair share of musicians who are so into the gear but have not improved in their skill much and on the other hand, have heard some amazing, soul-stirring music from blues masters that have played the same guitar all their life!

Al Tan tries to be a guitarist when he’s not building websites. One of the best resource to learn guitar online that he’s come across which has step-by-step guitar lessons on video is www.LearnMusicFrom.Us/Guitar http://www.LearnMusicFrom.Us/Guitar .
